§ 1. General provisions
- The SpecOpsLab website, available at https://specopslab.com (hereinafter: the “Website”), is operated by Damian Łukasiewicz, conducting business under the name Silent Hero Damian Łukasiewicz, address: ul. Miedziana 18/3, 53-441 Wrocław, Polska, NIP (Tax ID): 5562442970, REGON (Statistical No.): 364901801, entered in the Centralna Ewidencja i Informacja o Działalności Gospodarczej (Polish Central Register and Information on Economic Activity) (hereinafter: the “Seller”).
- Contact with the Seller: e-mail [email protected].
- These Terms set out the rules for using the Website, including the provision of electronic services and the sale of digital content. The Terms are made available free of charge on the Website in a manner that allows them to be downloaded, stored and printed.
- The Website is educational in nature. The Seller is not affiliated with any armed forces, services or units to which the content of the Website relates, and does not act on their behalf.
§ 2. Definitions
- User – a person using the Website.
- Customer – a User who purchases Digital Content.
- Consumer – a Customer who is a natural person purchasing for a purpose not directly related to their business or professional activity.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person (Article 38a of the Consumer Rights Act). The provisions of the Terms relating to the Consumer apply to such a person accordingly.
- Calculator – a free tool on the Website which, based on the results entered by the User, estimates how the User compares against the published fitness standards of a given unit and shows indicative pay.
- Digital Content – a paid report generated automatically on the basis of the results entered by the Customer, in the variants described on the Website next to the purchase button (e.g. a report, a report with a training plan, a package of reports for several units with a code).
- Package Code – a code entitling the holder to generate further reports within a purchased package.
§ 3. Free services
- Use of the Calculator and of the informational content of the Website is free of charge and does not require registration.
- Results entered into the Calculator are processed in the User’s browser and are not sent to the Seller, unless the User starts a purchase of Digital Content.
- The contract for the use of the Calculator is concluded when the User starts using it and terminates when the User leaves the page.
§ 4. Technical requirements
To use the Website, the following are required: a device with internet access, an up-to-date web browser with JavaScript enabled and – when making a purchase – an active e-mail address. The Seller is not responsible for limitations resulting from the settings or software of the User’s device.
§ 5. Purchase of Digital Content
- Prices shown on the Website are gross prices (they include VAT, if due). The currency depends on the language version of the Website and is visible before the order is placed.
- To purchase Digital Content, the Customer: (a) enters their results in the Calculator, (b) selects a variant, (c) accepts the Terms and gives the consent referred to in § 7(2), (d) proceeds to payment and completes it.
- Payments are handled by Stripe Payments Europe, Ltd. The available payment methods (e.g. payment card, BLIK, Przelewy24) are shown on the payment page.
- The contract for the sale of Digital Content is concluded when the payment is confirmed by the payment operator.
- Purchases are possible from the countries indicated on the Website. From other countries the purchase button is inactive.
§ 6. Delivery of Digital Content
- Digital Content is delivered without undue delay after payment is confirmed: on the Website and by e-mail to the address provided at payment, in the form of a link.
- The link to the report is active for 30 days from purchase. The Customer may save or print the report during this period.
- The Package Code is valid for 180 days from purchase and allows the number of reports indicated at purchase to be generated, each for a different unit.
- Together with the Digital Content, the Seller sends to the e-mail address a confirmation of the conclusion of the contract, including confirmation of the consent referred to in § 7(2).
§ 7. Right of withdrawal
- A Consumer who has concluded a distance contract may, as a rule, withdraw from it within 14 days without giving any reason.
- Pursuant to Article 38(1)(13) of the ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Polish Consumer Rights Act of 30 May 2014), the right of withdrawal does not apply to a contract for the supply of digital content not supplied on a tangible medium for which the Consumer has paid, if the Seller has begun performance with the express and prior consent of the Consumer, who was informed before performance began that they would lose the right of withdrawal once performance has been completed, acknowledged this, and the Seller has provided them with confirmation on a durable medium.
- Before proceeding to payment, the Customer ticks a box on the Website by which they consent to the delivery of the Digital Content immediately after payment and acknowledge the loss of the right of withdrawal. Without this consent the purchase is not possible. The Seller sends confirmation of the consent, with date and time, by e-mail (§ 6(4)).
- If, for technical reasons, the Digital Content is not delivered, the right of withdrawal does not expire. In such a case the Consumer may withdraw from the contract by sending a statement to [email protected] (model form in Annex No. 1). The Seller refunds the payment without undue delay, and no later than within 14 days, using the same payment method.
§ 8. Conformity of Digital Content with the contract. Complaints
- The Seller is liable to the Consumer for any lack of conformity of the Digital Content with the contract on the terms set out in Chapter 5b of the Consumer Rights Act.
- A complaint may be submitted by e-mail to [email protected], stating the e-mail address used for the purchase and a description of the problem (e.g. the report does not open, contains an error).
- The Seller responds to the complaint within 14 days of receiving it. If the complaint is justified, the Seller brings the Digital Content into conformity with the contract (e.g. generates the report again) and, where this is not possible, refunds the price paid.
§ 9. Nature of the content and liability
- The reports and the Calculator are solely educational and indicative in nature. They are based on publicly available standards and rates, which units and institutions may change without notice. For each standard, the Website states the source and the date of verification.
- A result on the Website is not a guarantee of admission to any unit or formation and does not replace official recruitment procedures.
- The training plan is a general scheme and does not constitute medical advice or an individually tailored programme. A doctor should be consulted before starting intensive training. The User trains at their own risk, to the extent permitted by law.
- Pay amounts are indicative (gross, according to public tables) and do not constitute a job offer or a commitment by any employer.
§ 10. Intellectual property
The content of the Website and the reports are protected by copyright. The Customer may use the report for their own personal use. Distribution or resale of the reports requires the Seller’s consent.
§ 11. Dispute resolution
- The Consumer may use out-of-court means of handling complaints and pursuing claims, among others by contacting the municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or the provincial inspectorate of the Trade Inspection (wojewódzki inspektorat Inspekcji Handlowej). Information: https://www.uokik.gov.pl.
- A Consumer from another EU Member State may contact the European Consumer Centre in their country (ECC-Net).
§ 12. Governing law
Polish law applies to contracts concluded through the Website. The choice of law does not deprive the Consumer of the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence.
§ 13. Personal data
The rules for processing personal data are set out in the Privacy Policy: https://specopslab.com/en/privacy/.
§ 14. Amendments to the Terms
- The Seller may amend the Terms for important reasons (a change in legislation, a change in services, security considerations). An amendment does not apply to contracts concluded before it enters into force.
- These Terms are effective from 19.10.2026.
